Terms and Conditions for Web Design Services

1. Nature of Service

This agreement outlines the terms under which I ("Designer/Developer") will provide web design and related services to you ("Client"). This work is being done as a freelance / startup-level project, and may be part-time in nature.

2. No Guarantees

This project is provided on a "best effort" basis. As this is a personal or early-stage service:

• No guarantees are made regarding website performance, uptime, SEO ranking, or business results.
• The final outcome may vary depending on scope, timeline, and tools used.

3. Limited Liability

I will not be held responsible for:

• Any losses (financial, business, or reputational) from using the website
• Issues caused by third-party tools (e.g., hosting, plugins, CDNs)
• Any technical limitations, bugs, or errors after delivery

The Client accepts all risks associated with using or publishing the website.

4. Content Responsibility

The Client agrees to:

• Provide all content (text, images, media), or confirm permission to use any provided assets, unless otherwise agreed upon
• Ensure that no copyrighted, illegal, or harmful material is submitted

I am not responsible for the legality of content provided by the Client.

5. Revisions & Changes

After the website's launch, any additional design, functionality changes, or updates beyond the scope of the original project will be subject to additional charges. Minor content updates, such as text or image changes, may be done at no additional cost within the first [14] days of the website launch.

6. Payment Terms (If Applicable)

If a fee is agreed upon:

• A small deposit may be required before work begins
• Full payment must be made before the website is launched
• Payments are to be made via bank transfer unless specified otherwise

7. Use of Work in Portfolio

Unless the Client requests otherwise in writing, I reserve the right to showcase the completed work (or parts of it) in my portfolio or on social media as part of my experience.

8. Ownership and Hosting

Upon full payment, the Client is granted a non-transferable license to use and host the website for their business purposes. Ownership of the code remains with the developer unless otherwise agreed.

Hosting and domain services are subject to a yearly fee, which may change based on third-party service provider costs or other factors. The Client will be notified in advance of any changes to the fee. If the yearly payment is not received by the due date, the website may be taken offline until payment is made.

9. Right to Terminate

I reserve the right to terminate the project or working relationship at any time if the Client is unresponsive, fails to provide necessary materials, breaches the terms of this agreement, engages in disrespectful behavior, or for any other reason that significantly impacts the ability to complete the project professionally.

In such cases, any payments made up to that point are non-refundable, and any work completed may be handed over at my discretion.

10. Governing Law

This agreement is governed by the laws of Malaysia. Any legal matters will be handled under Malaysian jurisdiction.

By working with me, the Client agrees to these terms. These are meant to protect both sides and keep expectations clear during the project.
